1. Service Description

Resumiq (“Company,” “we,” “us,” or “our”) provides an AI-powered resume optimization service that analyzes job descriptions and rewrites resumes to improve compatibility with Applicant Tracking Systems (“ATS”). Our platform generates optimized resume content, ATS compatibility scores, keyword analyses, and cover letters.

These Terms of Service (“Terms”) govern your access to and use of the Resumiq website, applications, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

2. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, complete, and current information during registration
• Maintain the security and confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activities that occur under your account
• Not create accounts for any other person without their express consent

We reserve the right to terminate or suspend accounts that violate these Terms, engage in fraudulent activity, or otherwise abuse the Service.

3. Acceptable Use

You agree not to use the Service to:

• Submit false, misleading, or fraudulent resume content
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit harmful, offensive, or malicious content
• Attempt to reverse-engineer, scrape, or exploit the Service
• Use the Service for commercial reselling without our written consent
• Circumvent usage limits or access restrictions

We reserve the right to investigate and take appropriate action against any violation of these acceptable use policies, including suspension or termination of your account.

4. Payment Terms

Resumiq offers a free tier and paid subscription plans (Pro monthly, Pro yearly) as well as a one-time Lifetime plan. Payment is processed securely through Paddle, our payment processor.

By subscribing to a paid plan, you agree to:

• Pay all applicable fees in advance for each billing period
• Provide accurate and complete billing information
• Authorize automatic recurring charges for subscription plans
• Pay any applicable taxes

Prices are listed in US Dollars. We reserve the right to modify pricing with 30 days' advance notice to existing subscribers.

5. Cancellation and Refunds

You may cancel your subscription at any time through your Account page or by contacting us at support@resumiq.tech. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• No partial refunds are provided for unused portions of a billing period
• Your account will revert to the free tier at the end of the billing period

Lifetime plan purchases are non-refundable except as required by applicable law. For subscription plans, refund requests made within 7 days of the initial purchase may be considered on a case-by-case basis. Contact support@resumiq.tech to submit a refund request.

6. Intellectual Property

The Service, including its design, code, features, and content created by Resumiq, is owned by the Company and protected by intellectual property laws.

You retain ownership of the resume content and personal information you submit to the Service. By using the Service, you grant Resumiq a limited, non-exclusive license to process your content solely for the purpose of providing the optimization services you request.

AI-generated resume output is provided for your personal use. You may use the optimized content freely in your job applications.

7. Privacy

Your privacy is important to us. Our Privacy Policy, incorporated herein by reference, explains how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. RESUMIQ DOES NOT WARRANT THAT:

• The Service will be uninterrupted, error-free, or secure
• AI-generated content will be accurate, complete, or suitable for your specific circumstances
• Use of the Service will result in job interviews or employment
• ATS scores reflect the actual scoring of any particular employer's system

Resume optimization is one factor among many in a job search. We make no guarantee of employment outcomes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RESUMIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITIES, OR EMOTIONAL DISTRESS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RESUMIQ IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Philippines.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by email or through a prominent notice on the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
